PART I: MASTER TERMS & CONDITIONS OF USE

1. General Account Registration & Website Use

• Binding Agreement: Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree, you must cease usage immediately.
• Age Restrictions: You must be at least 18 years of age to use this Website or register for any events. Minors under the age of 18 are strictly prohibited from registering as a User or transacting on the website.
• Account Credentials: You are solely responsible for maintaining the confidentiality of your account credentials and password. RaceME reserves the right to suspend or cancel your registration with immediate effect for any breach of security or terms.

2. Payment Gateway & Financial Transactions (TelR Compliance)

• Accepted Methods: Visa and MasterCard credit/debit cards are accepted through this site. All financial transactions will be natively processed and settled in United Arab Emirates Dirhams (AED).
• Sanctions Compliance: In accordance with UAE law, Tri Race Events Management (RaceME) will not trade with, process payments for, or provide any services to individuals or entities located in OFAC and sanctioned countries.
• Transaction Records: The cardholder must retain a copy of transaction records, merchant policies, and administrative rules for their own record-keeping.

3. Participant Prerequisites (Licensing, Fitness, & Insurance)

• Federation Licensing: You agree to hold a valid license issued by the UAE Triathlon Federation to participate in specific regulated events. It is your sole responsibility to maintain a valid license via the official federation channels. RaceME will not be held responsible for late cancellations or denial of race entry should you be found without a valid license.
• Medical Fitness & Costs: You confirm that you are physically fit and medically able to participate in your registered events. You explicitly acknowledge that you possess valid medical insurance coverage for sports participation within the UAE. Any medical treatment, emergency transport, or hospital expenses incurred during the event are entirely your financial responsibility.

4. Cancellation, Postponement, & Transfer Tiers

Unless specific Race Entry Insurance has been purchased at the time of checkout (see Section 5), the following strict refund and cancellation parameters apply:

• 45+ Days Prior to Event: Cancellations are permitted, subject to a deduction of an AED 50 administrative fee.
• 5 to 44 Days Prior to Event: No monetary refunds are permitted. Participants may request a race credit for the same active race season (September – April) or execute a name transfer to another individual, subject to an AED 50 administrative fee.
• 0 to 4 Days Prior to Event: No credits, refunds, or third-party transfers are permitted under any circumstances.
• Organiser Postponement/Cancellation: RaceME reserves the right to alter, postpone, or cancel an event at any time without providing a reason. If an event is postponed or cancelled, you will be automatically rolled into the next similar type event in our schedule, losing the right to claim a refund. Missing an event for personal reasons does not constitute an organiser cancellation.

5. Race Entry Insurance Terms & Conditions

If you choose the optional Event Insurance at checkout, the standard cancellation policies are modified as follows:

• 14+ Days Prior to Event: You may cancel your entry and receive a 100% refund of your entry fee by notifying [email protected].
• Less Than 14 Days (or Post-Race Pack Receipt): Cancellations are permitted but will be subject to an AED 50 administrative fee.
• Postponement by Organiser: If insured, you retain the choice of receiving a 100% refund or an upcoming event transfer credit.
• Scope Limits: Insurance must be purchased within a strict 48-hour window of your event registration. Insurance expires automatically at the end of the active racing season (April 30).

6. Promotional Offers, Coupons, & “Golden Tickets”

• Non-Transferable: Offers, coupons, and Golden Tickets hold zero cash value, cannot be traded, and cannot be transferred to a third party. They must be utilised exclusively by the original purchaser.
• Exclusions: Promotional offers cannot be stacked or used in conjunction with any other sales, promotions, or early-bird discounts. Race Entry Insurance is explicitly excluded from all promotional bundles.
• Distance Modifications: You may downgrade your distance category free of charge (no refunds provided for price differences). Upgrading your distance will require paying the full pricing gap plus an AED 50 administrative fee.

7. Health, Safety, & Regulatory Compliance

• Health Screening: RaceME reserves the right to enforce on-site health screening, including temperature checks (which must register below 38.0°C for entry).
• Compliance Protocols: Participants must follow all on-site safety signage, sanitation protocols, and venue-specific guidelines. Failure to adhere to safety rules will result in immediate expulsion from the event without refund eligibility.

8. Intellectual Property & Digital Usage Limits

• Ownership: All content displayed on the Website—including text, graphics, logos, layouts, and underlying source code—is the exclusive intellectual property of Panache Middle East FZ LLC/RaceME.
• Prohibited Actions: Users may download or print a single copy of site content strictly for personal, non-commercial evaluation. You are strictly prohibited from reproducing, copying, modifying, or commercialising site materials without explicit prior written authorisation.

9. Limitation of Liability

• “As Is” Disclaimer: All online tools, services, and race scheduling information are provided on an “as is” and “as available” basis. RaceME gives no warranty regarding system uptimes, website bugs, or malware.
• Exclusion of Damages: To the maximum extent permitted under UAE law, Tri Race Events Management (RaceME) shall not be liable for any indirect, consequential, or economic losses, including loss of profits, commercial opportunities, or data corruption arising from your use of the platform or participation in events.

10. Governing Law & Jurisdiction

• These Terms & Conditions shall be governed by, interpreted, and construed in accordance with the laws of the Emirate of Dubai and the applicable Federal Laws of the United Arab Emirates. Any dispute or claim arising from these terms shall be subject to the exclusive jurisdiction of the Courts of Dubai.

PART II: PRIVACY POLICY

1. Scope & Regulatory Framework

• This Privacy Policy outlines how Tri Race Events Management (RaceME) collects, stores, processes, and protects the personal data of its Users.
• This policy is structured to comply strictly with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). RaceME operates as the “Data Controller” for all systems managed via www.raceme.ae.

2. Types of Data Collected

We collect both personal data you provide directly and structural data collected automatically, including:

• Full name, age, date of birth, gender, and nationality.
• Contact details (email address, mobile number) and emergency contact information.
• Professional descriptors (job title, industry).
• Event-specific details (T-shirt size, athletic preferences).
• Technical metadata (IP address, web browser type, operating system, and site navigation paths).

3. Purpose of Processing

Your personal data is collected and processed for the following operational reasons:

• Processing your event registrations, assigning race numbers, and formatting timing chips.
• Internal record keeping, financial accounting, and tax compliance.
• Sending essential event briefings, emergency alerts, and post-race confirmations.
• Direct email/SMS marketing regarding upcoming race fixtures, subject to your explicit opt-out rights.

4. Financial Data Privacy (TelR Integration)

• Zero Storage of Cards: All credit/debit card details and personally identifiable financial information will NOT be stored, sold, shared, rented, or leased to any third parties by RaceME.
• Gateway Security: Financial transactions are handled securely via our partner payment gateway, TelR. RaceME does not pass any payment instrument credentials to outside entities.

5. Data Sharing Restrictions

We do not sell your personal data. We may share relevant data points only with verified third parties for operational execution, including:

• Corporate affiliates, official race sponsors, and athletic governing bodies (e.g., UAE Triathlon Federation) for compliance and tracking.
• Professional timing partners, web hosts, and security vendors.
• UAE judicial or governmental regulatory entities when legally compelled.

6. Security Measures & Retention Timeline

• We use robust technical safeguards, including server encryption, unique user credentials, and SSL transport layer security to shield your information. However, no data transmission over the internet can be guaranteed 100% secure.
• Your data will be stored within our systems only for the duration required to execute our commercial and athletic services, or as mandated by UAE statutory data retention laws.

7. Your Legal Rights as a Data Subject

Under the UAE PDPL, you possess explicit rights regarding your data, which can be exercised by contacting [email protected]:

• Right to Access: Request a copy of the personal information held about you.
• Right to Correction: Request the immediate rectification of incomplete or faulty data.
