These Terms and Conditions govern your use of the website https://raceme.ae (the “Website”) and your registration and participation in events organised by Tri Race Events Management (“RaceME”). By accessing the Website or registering for an event, you agree to be bound by these terms. If you do not agree, you must stop using the Website immediately.

1. General Use & Account Registration

• Age Restriction: You must be at least 18 years of age to use this Website and register for events. Minors (under 18) shall not register as Users or transact on the Website directly.
• Account Accuracy: You must ensure that all details provided during registration are accurate, complete, and kept up to date.
• Security: You are responsible for maintaining the confidentiality of your account and password. If we suspect misuse or a security breach, we reserve the right to suspend your account or require a password change.
• Termination: We may suspend or cancel your registration with immediate effect for any reasonable purpose or breach of these terms. You may cancel your registration in writing at any time.

2. Payment Gateway & Transactions (TelR)

• Accepted Payments: Visa and MasterCard are accepted. All transactions will be processed in United Arab Emirates Dirhams (AED).
• Sanctions Compliance: Tri Race Events Management (RaceME) will not trade with or provide any services to OFAC-sanctioned countries.
• Record Keeping: The cardholder must retain a copy of all transaction records, merchant policies, and rules.

3. Participant Prerequisites: Medical & Licensing

• Medical Insurance & Fitness: By registering, you confirm that you have valid medical insurance/coverage to participate in a race while in the UAE. You acknowledge that medical treatment in the UAE may incur charges, which are entirely your responsibility.
• Federation License: You agree to hold a valid license issued by the UAE Triathlon Federation to participate in specific events. It is your sole responsibility to maintain this license. RaceME will not be held responsible for late cancellations or denial of participation if you fail to present a valid license when required by the Federation.

4. Cancellation, Postponement & Transfer Policy

Unless you have purchased specific Race Insurance (see Section 5), the following strict cancellation tiers apply:

• 45+ Days Prior to Event: You may cancel your entry and receive a refund, subject to an AED 50 administration fee.
• 5 to 44 Days Prior to Event: No refunds are permitted. You may request a credit for the same race season (September – April) or a name transfer to another participant, subject to an AED 50 administration fee.
• 0 to 4 Days Prior to Event: No credits, refunds, or transfers are permitted under any circumstances.
• Event Postponement/Cancellation: RaceME reserves the right to cancel or postpone an event at any time without providing a reason. In such cases, you will be automatically rolled over to the next similar event in our schedule. If the cancellation/postponement falls within the 2022-2023 season, there is no eligibility for a refund. Missing a rescheduled event does not entitle you to a refund or further transfer.

5. Race Entry Insurance Terms

If you purchased the optional Race Insurance during checkout, the following upgraded terms apply:

• 14+ Days Prior to Event: You may cancel your entry for a 100% refund. You must notify RaceME via email at [email protected].
• Less Than 14 Days (or Post-Race Pack Receipt): Cancellations are permitted but will be subject to an AED 50 administration fee.
• Event Postponement/Cancellation by RaceME: You will receive a 100% refund or the option to transfer to any upcoming event.
• Validity & Expiry: Insurance is valid per person, per event. It must be purchased within 48 hours of the original event registration. Insurance cannot be transferred to subsequent events unless RaceME postpones the original event. All insurance coverage for the current season strictly expires on April 30, 2023.

6. Promotional Offers, Coupons & “Golden Tickets”

When purchasing or utilising any promotional offer, discount, or ticket (e.g., “1000 AED credit for 500 AED” or Golden Tickets), you agree to the following:

• Validity: Offers are strictly valid for events between October 1, 2022, and May 1, 2023.
• Non-Transferable & No Cash Value: Offers and tickets hold no cash value, cannot be traded, sold, or transferred to a third party, and must be used strictly by the original purchaser.
• Exclusions: Offers cannot be used in conjunction with any other coupons, sale items, or early-bird discounts. Race Entry Insurance is never included in promotional offers and must be purchased separately.
• Modifications: You may downgrade your race distance free of charge (no refunds for the price difference). Upgrading your distance will incur the full price difference plus an AED 50 administration fee.
• Refunds: There is zero refund eligibility for any promotional offer purchased, even if an event is missed or cancelled (in the case of cancellation, you will be rolled into the next available event).

7. Health, Safety & COVID-19 Regulations

• You consent to mandatory temperature checks before entering the event area (must be below 38.0°C).
• You agree to wash/sanitize hands frequently and wear a mask at all times when not actively competing.
• You must maintain safe social distancing and adhere to all venue-specific safety regulations.
• You agree to sign and present any additional health waivers if requested by the organiser. Failure to adhere to these rules will result in immediate removal from the event without refund.

8. Website Intellectual Property & Acceptable Use

• Ownership: All content on the Website (text, graphics, logos, code) is the exclusive property of RaceME.
• Permitted Use: You may retrieve, display, download (to a local drive), and print one copy of the content strictly for personal, non-commercial use.
• Prohibited Use: You may not modify, distribute, reproduce, or commercialise any content without explicit written permission. You may not use the Website in any way that causes damage, is unlawful, harassing, or transmits harmful software/viruses.
• User-Submitted Content: You represent that you own the rights to any content you submit to the Website. You agree not to upload false, defamatory, obscene, or infringing material, and you agree to fully indemnify RaceME against any claims arising from content you supply.

9. Disclaimers & Limitation of Liability

• Service “As Is”: The Website and its services are provided on an “as is” and “as available” basis. RaceME gives no warranty that the Website will be free of defects, errors, or malware.
• No Liability for Indirect Losses: To the maximum extent permitted by law, RaceME accepts no liability for business losses, loss of profits, data corruption, or any special, indirect, or consequential damages arising from your use of the Website or participation in events.
• Exclusions: Nothing in these terms limits liability for death or personal injury caused directly by our negligence, or for fraud/fraudulent misrepresentation.
• Third-Party Links: We assume no responsibility for the content, security, or privacy practices of any external websites linked on our platform.

10. General & Governing Law

• Severability: If any provision of these terms is deemed invalid or unenforceable by a competent court, that provision will be deleted, and the remaining provisions will continue in full force and effect.
• Amendments: RaceME reserves the right to modify these terms at any time. Revised terms apply from the date of publication.
• Third-Party Rights: The Contracts (Rights of Third Parties) Act 1999 shall not apply; no third party has the right to enforce these terms.
• Governing Law: These Terms and Conditions, alongside the Privacy Policy, constitute the entire agreement between the parties. This Agreement shall be governed by and interpreted according to the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates. All disputes shall be subject to the exclusive jurisdiction of the Courts of Dubai.
